  4. Parts warranties
    Fitness Source fully backs all of the parts and products it sells. All our parts have been carefully selected and tested, which is why, in addition to any manufacturers warranties, we offer a "hassle free" exchange policy. All Fitness Source parts meet or exceed original equipment manufacturer specifications and are warranted free from defects or failure for 45 days unless a longer warranty is listed. Fitness Source pays shipping on warranty parts within first 45 days.
  5. Product warranties
    Fitness Source fully backs any of the manufacturer warranties of all the products we sell. Extended warranties are offered at point of sale for an additional charge, see in store for complete details. Fitness Source technicians will service all products within a 30 kilometre (km) radius of the nearest location to the customer. Additional charges are incurred outside of the 30 kilometre (km) territory.
    • 5.1 What Is Covered
      Service performed hereunder shall consist of labour and parts necessary to restore your product (the “Product”) to normal operating condition (the “Plan”).
      This Plan does not however cover:
      1. Defects or damages resulting from misuse, abuse, neglect, after sale modifications, or cosmetic damage;
      2. Product that has the serial number removed, altered or made illegal (defaced);
      3. All plastic surfaces and other externally exposed parts that are scratched or damaged due to normal use;
      4. Defects and/or damages from improper maintenance as a result of service by anyone other than an authorized service centre;
      5. Products used for commercial or institutional purposes; and
      6. Damages caused by use of incorrect power supply/adaptors.
      This Plan does not cover also shipping charges, or any other charges associated within transportation of Product or parts. Many oversights, which are not covered under this Plan, can be due to simple circumstances such as the Product not being switched on, being unplugged, or a fuse blown at the junction box. It is your responsibility to provide a non-technical cleaning to ensure a normal operating environment as described in the manufacturers’ instruction manual for the Product.
    • 5.2 Term
      The term of this Plan begins on the date of purchase of the Product and will expire 48 or 60 months following the date of purchase of the Product depending on the Plan chosen by you which will be indicated on your original invoice. In the event your Product is being serviced by an authorized services centre when this Plan expires, the term of this Plan will be extended until covered repair has been completed. Fitness Source® may, at its sole option, renew this Plan; however, we are not obligated to offer you another service plan upon termination of this Plan, in the event you ask for one.
    • 5.3 Cancellation
      Fitness Source® may cancel this Plan at its option on the basis of (a) fraud or misrepresentation; (b) commercial or rental use of the product (except if approved by Fitness Source®; or (c) an unauthorized repair of a product. You may cancel this Plan for any reason at anytime within 30 days of purchase and receive a full refund of the Plan price, less the cost of claims paid (if any). To receive your refund, you must deliver the cancellation request along with this document and all original invoices to the Fitness Source® store where you bought the product. After 30 days, no refund will apply.
      No cancellation fee applies to this Plan.
    • 5.4 What To Do When Your Product Fails To Operate
      Contact the Fitness Source® store where the Product was purchased. We will select an authorized repair centre, which will contact you to arrange for your service. If the completion of your repair is not satisfactory contact us immediately. All repairs must be authorized by a representative of Fitness Source® prior to performance of work.
    • 5.5 Replacement Option
      At our sole option, we may replace your product with a new or refurbished product of like kind and quality if we are unable to repair your Product, or where the cost for repair may exceed the current retail replacement value of your Product. The price of the replacement product shall not exceed that retail purchase price of the Product. If we elect to replace your Product and a replacement product, as described above, is not available, we will pay you a cash settlement. The amount of the cash settlement shall not exceed the current retail cost of a replacement product of like kind and quality, and, such retail cost shall not exceed the retail purchase price you paid for the Product.

      • Replacement of your Product or payment of a cash settlement will fulfill this Plan in its entirety and will cancel and discharge any further obligations under this Plan.
    • 5.6 Parts Non-Availability
      In the event that replacement parts needed to repair your Product should become reasonably unavailable during the coverage period of the Plan, Fitness Source® shall be excused from performance hereunder and you shall receive a refund of the purchased price paid by you for the Plan less the value of any services that have been provided before the date of refund. In no event shall Fitness Source® be liable for any damages as a result of the unavailability of replacement parts.
    • 5.7 No-Lemon Policy
      During the term of this Plan, after three (3) service repairs have been completed on the same component of the Product and that the Product component requires a fourth repair, as determined by us, we will replace it with a product of comparable performance. If a comparable product is not available, we can elect to issue a cash settlement pursuant to “replacement option” above. Such replacement or cash settlement shall constitute fulfillment of this Plan and will cancel and discharge all further obligations under this Plan.
    • 5.8 Types Of Service And Service Location
      In the event you purchase In-home/On-site service, as indicated on your purchase receipt, repairs will normally be performed at your residence. In order for the Plan to provide In-home/On-site service, the manufacturer’s warranty must provide a minimum of 90 days on-site service. An adult (of legal age) must be present at the location where on-site service will be performed. If you live beyond a thirty (30) kilometre radius of an authorized repair centre, you will be required to ship the Product to the designated repair centre or you will be charged for the time required for travel at the rate of $35 per hour from the closest authorized repair centre.
    • 5.9 Transfer
      This Plan is transferable with the written consent of Fitness Source® for a fee of $50.00.
    • 5.10 Entire Agreement
      Your original purchase invoice and these terms and conditions set forth the entire agreement and supersede all prior negotiations, understandings and agreements concerning the subject matter. No amendment or modification of these terms and conditions will be binding except by a written agreement signed by you and Fitness Source®.
    • 5.11 Limitation Of Liability
      In no event will Fitness Source® be liable for special, indirect, incidental or consequential damages relating directly or indirectly to this plan. Furthermore, this plan is your sole express warranty with respect to the covered products. All implied warranties with respect to the product(s) are hereby expressly excluded.
    • 5.12 Language
      You have specifically requested the English version of this Plan, a French version of which is available upon request. Vous avez spécifiquement exigé la version anglaise de ce Programme et la version française est disponible sur demande.
    • 5.13 Governing Laws
      This plan shall be interpreted and enforced according to the laws of the province of Quebec, Canada.
